General Terms and Conditions

§1 Scope of application

(1) These General Terms and Conditions of Business (“GTC”) apply to all accommodation provided in apartments and all associated services between the Board Inn – Haus Regensburg, Susanne Amann (hereinafter referred to as “Board Inn”) and the tenant (“Customer” or “Guest”) in the context of accommodation in the Board Inn – Haus Regensburg (“Board Inn – Haus Regensburg”).
(2) These GTC apply exclusively. Conflicting or deviating
terms and conditions of the customer/guest or third parties shall not apply, even
if the Board Inn – Haus Regensburg does not separately object to their validity in individual cases
.

§2 Conclusion of contract

(1) The accommodation contract shall come into effect upon acceptance of the booking by BoardInn – Haus Regensburg. The Board Inn – Haus Regensburg is free to confirm the booking to the customer/guest in writing.

§3 Accommodation

(1) The maximum duration of occupancy is three (3) months. If available, an extension is only possible after an interruption, but there is no entitlement.
(2) The Board Inn has a right of access to all apartments in order to maintain the regularity of occupancy and cleanliness of the rooms.
(3) Subletting or re-letting of the apartments is not permitted. Occupancy of the apartments by more than the number of persons booked requires the prior written consent of the Board Inn.
(4) Smoking is strictly prohibited in all rooms of the boarding house. Damage such as burn marks and holes in the furnishings of the apartment shall be charged to the customer/guest at replacement value. Costs incurred by the deployment of the security service or the fire department due to smoke/fire alarms being triggered by unauthorized smoking in the apartments will be charged to the person responsible. If the smoke detectors are removed or damaged without permission, the costs of the necessary reprogramming of the fire alarm system by the installer will also be charged to the person responsible.
(5) Pets are generally not permitted.
(6) Any waste produced must be disposed of in the designated waste containers in the boarding house. Leftover food must be removed from the fridge/cupboards on departure. Otherwise, an additional cleaning fee of EUR 25 will be charged.
(7) In the interests of good neighborly relations, disturbing activities must be refrained from between 22:00 and 06:00. Radio and television sets and other sound reproduction devices may only be operated at room volume at all times.
(8) The Internet connections provided in the apartments may only be connected to the end devices provided for this purpose (laptop etc.). The installation of additional hardware such as routers etc. will result in an immediate disconnection and the Board Inn reserves the right to terminate the accommodation contract without notice.
(9) Building and fire regulations must be observed and complied with. In the absence of the customer/guest and in stormy and rainy weather, the doors and windows must be carefully closed.
(10) Transponders, keys and damaged items that are not returned will be charged to the customer/guest, even retrospectively.

§4 Provision

(1) Booked apartments are available from 16:00 on the day of arrival.
(2) The Board Inn is obliged to keep the apartment booked by the Customer/Guest available and to provide the agreed services. Unless otherwise agreed, there is no entitlement to the provision of specific apartments. Otherwise, the service description from the booking confirmation shall apply.
(3) If the apartment reserved according to the booking confirmation is not available, the Board Inn can provide an equivalent replacement. Further claims of the customer/guest are excluded.
(4) The customer/guest is obliged to identify himself/herself on arrival and to complete and sign the registration form in full with his/her personal details.
(5) Departure must take place by 10:00 a.m. at the latest on the day of departure.
(6) If the apartment is used after 10:00 a.m. on the day of departure, 50% of the accommodation price will be charged until 6:00 p.m. and 100% of the accommodation price after 6:00 p.m.
. This is only possible by prior arrangement. The assertion of
further damages remains reserved.

§5 Prices

(1) The agreed prices include the respective statutory value added tax. If there is an increase in VAT after the conclusion of the accommodation contract, the tax rate applicable at the time of use of the apartment shall apply.
(2) The customer/guest may only offset undisputed or legally established claims.

§6 Payment

(1) The Board Inn is entitled to make the binding reservation of the apartments dependent on the payment of a deposit. The required down payments must be paid by the date stated on the invoice. This applies in particular to accommodation contracts with a term of more than two (2) months.
(2) Unless otherwise agreed, the invoice amount to be paid by the customer/guest is due before arrival, at the latest on the day of arrival.
(3) Bank transfer to the bank account specified on the invoice and the payment methods offered on these pages are accepted as payment methods.
(4) BoardInn Haus Regensburg charges a reminder fee of EUR 5 for each reminder.
(5) If the customer is not also the guest, both the customer and the guest shall be liable to the Board Inn as joint and several debtors for the obligations arising from the accommodation contract,

(6) If a customer/guest does not pay the agreed booking amount or does not pay it on time, the Board Inn shall have a lien on the items brought in by the customer/guest to secure its claim arising from the service provided, including expenses. It thus has the right to retain the items subject to the lien until payment has been made and, if necessary, to utilize them to satisfy its claims in accordance with the statutory provisions.

§7 Cancellation/termination by the guest

(1) If the customer/guest cancels before moving into the apartment, a cancellation fee will be charged. Decisive for the calculation is the receipt of the notice of withdrawal in text form by the Board Inn.
(2) If the apartment is not rented to another party, the may demand the agreed accommodation price less a flat-rate deduction for saved expenses. The cancellation costs therefore amount to:
(a) 50% of the accommodation price in the event of withdrawal from 14 days to arrival and
(b) 100% of the booked accommodation price in the event of non-arrival.
(3) The customer/guest is at liberty to prove that the cancellation costs were not incurred or were not incurred in the amount stated.

§8 Right of withdrawal/termination by the Board Inn

(1) If a deposit or advance payment is not made, even after a reasonable grace period has expired, the Board Inn shall be entitled to withdraw from the accommodation contract.
(2) The Board Inn is entitled to terminate the accommodation contract without notice for good cause. Good cause shall be deemed to exist in particular if:
(a) force majeure or other circumstances beyond our control make it impossible to fulfill the accommodation contract;
(b) the apartments are booked under misleading or false statements of material facts, e.g. in the person of the customer, the guest or the purpose;
(c) the customer or guest allows a third party to use the apartment without the consent of the Board Inn;
(d) if, despite a warning from the Board Inn, the customer/guest disturbs other customers/guests or the accommodation establishment or the safety and reputation of the Board Inn in public or if he/she behaves in a manner contrary to the contract (in particular breach of §3 of these GTC) to such an extent that termination of the contract without notice is justified;
(e) the contractual partner is more than ten (10) days in arrears with payments.
(3) If the Board Inn terminates the accommodation contract in accordance with § 8 (2), the Board Inn reserves the right to claim the full accommodation price, unless the termination without notice is due to force majeure.

§9 Liability/statute of limitations

(1) The Board Inn is liable with the diligence of a prudent individual entrepreneur.
Claims for damages by the customer/guest are excluded. This shall not apply to damages resulting from injury to life, limb or health and in the event of a breach of typical contractual obligations of the Board Inn if the Boardinghouse is responsible for the breach of duty. Also excluded are other damages that are based on an intentional or grossly negligent breach of duty by Board Inn. A breach of duty by a legal representative or vicarious agent is equivalent to a breach of duty by Board Inn.
(2) Lost property will only be forwarded on request against prior reimbursement of costs. Otherwise, lost property will not be stored for longer than six (6) months.
(3) If the customer/guest is provided with a parking space, this does not constitute a safekeeping agreement. The Board Inn has no duty of supervision. In the event of loss of or damage to parked motor vehicles and their contents, the Board Inn shall only be liable in cases of intent and gross negligence; this also applies to parked bicycles. Paragraph 1 of this §9 applies accordingly.
(4) The Board Inn shall only be liable for financial losses suffered by the customer/guest in the event of intent or gross negligence. Notwithstanding this, the Board Inn shall also be liable for financial losses caused by negligence if the Board Inn has culpably breached a material contractual obligation.
(5) The Board Inn shall be liable for items brought in by the Customer/Guest in accordance with the statutory provisions. If the Customer/Guest wishes to bring in money, securities or other valuables with a total value of more than EUR 800 or other items with a total value of more than EUR 3,500, the Customer/Guest must conclude a separate storage agreement with the Board Inn.

§10 Final provisions

(1) The place of performance and payment as well as the place of jurisdiction is Regensburg.
(2) German law shall apply exclusively. The application of UN sales law and conflict of laws is excluded.
(3) Should individual provisions of these GTC be or become invalid or void, this shall not affect the validity of the remaining provisions. The parties are obliged to replace the invalid provision with a valid provision that comes closest to the original economic and legal intention.
Note:
The customer/guest acknowledges that the Board Inn stores data from the contractual relationship in accordance with Section 28 of the Federal Data Protection Act for the purpose of data processing and reserves the right to transfer the data to third parties (e.g. insurance companies) to the extent necessary for the fulfillment of the contract.
